What happens if you surrender a tenancy?

If you surrender a tenancy, the lease ends by mutual agreement between the tenant and landlord. Both parties agree to terminate the tenancy early, releasing the tenant from future rent payments and other obligations under the lease. The landlord regains possession of the property, and the tenancy is formally concluded. The terms of the lease may require the agreement to be documented/the surrender to be affected in a particular way.

What is the difference between surrender and termination?

The difference between surrender and termination lies in how a lease ends:

  • Lease surrender: This occurs when both the tenant and landlord mutually agree to end the lease early. It’s a voluntary process where the tenant gives up their lease rights, and the landlord accepts the return of the property.
  • Termination of lease: This can happen through various means, such as the expiry of the lease term, exercising a break clause, or through legal action if either party breaches the lease terms. Termination might not require mutual consent and can be initiated by either party under the conditions set out in the lease.

How do you negotiate a surrender of tenancy?

To negotiate a surrender of tenancy you will need to review the lease, assess your position, and approach the other party to the lease with a proposal. You will also need to negotiate terms, including any financial compensation, and formalise the agreement in writing. Legal advice is recommended to ensure the process is fair and legally binding.
